The City has two different subdivision processes depending on the number of lots created. The first is a two step process meant for developers of numerous lots requiring a Preliminary Plat and a Final Plat. The second is meant for homeowners who may be creating one or two new lots, combining multiple lots into a single lot, or changing the property line with a neighboring property. This second process requires a single application: a Lot Split, Lot Combination, or a Simple Plat depending on the situation. No subdivision can be approved that would result in lots that violate the performance standards of the zoning district in which the subdivision is located.
A Preliminary Plat requires a public hearing with the Planning Commission before City Council review. Neighboring property owners will be notified of the public hearing and a public hearing notice will be published in the Dakota County Tribune. A Preliminary Plat often is accompanied with a rezoning when a new zoning district is needed to allow the reduced lots sizes. Preliminary Plats may be designed to have multiple phases that would take multiple Final Plats to create the individual lots. Preliminary Plats will expire in one year if no Final Plat is applied for with 12 months of the Preliminary Plat approval. A Final Plat requires a Planning Commission recommendation and City Council approval, but a Final Plat does not require a public hearing nor neighboring property notification. A Final Plat evaluates if the request is comparable to the Preliminary Plat approval and often will include a subdivision agreement that regulates the public infrastructure construction necessary for the lots to become buildable.
Simple Plats, or Lot Splits require a public hearing with the Planning Commission before City Council review. Neighboring property owners will be notified of the public hearing and a public hearing notice will be published in the Dakota County Tribune. The new lots must be able to simple legal description, such as the West Half of Lot 3 or the Northern 110 Feet of Lot 5.
